Mediators' Ethics

The ethics of negotiation and mediation are anything but clear or simple. The articles listed here are among a growing number of writings which demonstrate why.

Key Publications:
  • In Defense Of Ambiguity;
  • Bias And Mediators' Ethics;
  • Patterns Of Bias In Mediation;
  • Confidential, More Or Less

In addition to Chris Honeyman's writings above, please see also the CPR-Georgetown Ethics Commission's Model Rule for the Lawyer as Third Party Neutral and Principles for ADR Provider Organizations. The CPR/Georgetown project is the most comprehensive effort to date to develop ethical principles for the field. Chris Honeyman was one of the commission members, and the CPR/Georgetown project drew from the above articles. Also see Chapters 18-20, 53 and 67 in The Negotiator's Fieldbook (Schneider, A.K. & Honeyman, C., editors; ABA, 2006.)
